TC1.1 — By accessing and placing an order with JWBIZ Ltd, you confirm that you are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below. These terms apply to jwbiz.com, its associated subdomains, and any email or other type of communication between you and JWBIZ Ltd.
TC1.2 — Under no circumstances shall JWBIZ Ltd team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if JWBIZ Ltd team or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.
TC1.3 — JWBIZ Ltd will not be responsible for any outcome that may occur during the course of usage of our resources. We reserve the right to change prices and revise our service policies at any time.
TC2.1 — JWBIZ Ltd grants you a revocable, non-exclusive, non-transferable, limited licence to download, install and use the website strictly in accordance with the terms of this Agreement.
TC2.2 — These Terms & Conditions are a contract between you and JWBIZ Ltd (referred to in these Terms & Conditions as "JWBIZ Ltd", "us", "we" or "our"), the provider of the JWBIZ Ltd website and the services accessible from the JWBIZ Ltd website (which are collectively referred to in these Terms & Conditions as the "JWBIZ Ltd Service").
TC2.3 — You are agreeing to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, please do not use the JWBIZ Ltd Service. In these Terms & Conditions, "you" refers both to you as an individual and to the entity you represent. If you violate any of these Terms & Conditions, we reserve the right to cancel your account or block access to your account without notice.
TC3.1 — To help explain things as clearly as possible in this Terms & Conditions, the following terms are defined as:
TC4.1 — You agree not to, and you will not permit others to:
TC5.1 — Payments are by debit/credit cards or online bank transfer. Please note we do not accept cash or cheques as payments. We are not V.A.T. registered.
TC5.2 — Work with a total invoice value of less than £1,000.00 — full payment must be made prior to work being commenced.
TC5.3 — Work with a total invoice value over £1,000.00: 50% must be made prior to work being commenced and the remainder must be paid upon completion or before the selected finishing time-frame, whichever comes first. You will be notified of the selected finishing time-frame before we start work.
TC5.4 — Websites will initially be published on one of our domains and will be transferred to your domain only after complete payment has been made.
TC5.5 — If you change your mind about any element of work after we have started, you may incur further costs to cover our time. All work carried out after any order has been completed is chargeable and payable.
TC5.6 — It is your responsibility to ensure all landing page content you supply to us conforms with your local laws and international laws.
TC5.7 — We will need your name, address, telephone number (landline, no mobiles), and a valid email address. If you are applying for our services for a business we will need your business contact details. We operate a strict Data Protection Policy. For more information, please click the Policies link on the footer menu.
TC5.8 — Sending us files that you believe may be infected will result in the termination of your account. Files that may be infected could harm our systems and put our other clients' services in jeopardy. Anyone who sends us such files will receive no refund for services already provided, even if prepaid. Further to this, you may leave yourself open to litigation and become blacklisted by sending us infected files.
TC5.9 — If any of the contact details you provide us with change, you agree to notify us without delay.
TC5.10 — Anyone registering with false credentials and identities, such as an alias name, will have their account immediately suspended should it become apparent to us. In such circumstances, there will be no refunds in arrears for services and/or products already provided.
TC6.1 — We build web pages around the content we are supplied with.
TC6.2 — To organise this we will need your text, photos, logo, videos and anything else that is relevant before we start work.
TC6.3 — You will be informed of the time frame we need to do this work from start to completion. Typically this is no more than one calendar month, as we will utilise different team members for various tasks which speeds up the process.
TC6.4 — Once we start, we need to keep the momentum going.
TC6.5 — We are happy to discuss and plan this so we both know what is expected.
TC7.1 — All clients using our platform to advertise items for sale must ensure their listings comply with these policies to maintain marketplace integrity and legal compliance.
TC7.2 — Items advertised for sale must be accurately described with truthful information regarding condition, history, specifications, and any known defects or issues. Clients must provide clear, genuine photographs of the actual item being sold — stock images or photos misrepresenting the item's condition are prohibited.
TC7.3 — Clients warrant that they have full legal ownership or explicit authority to sell each advertised item, and that items are free from liens, encumbrances, stolen property claims, or legal disputes.
TC7.4 — Prohibited items include but are not limited to: stolen goods, counterfeit products, items subject to outstanding finance agreements, and any items whose sale would violate applicable local, national, or international laws.
TC7.5 — We reserve the right to review, request modifications to, or remove any advertised item that violates these policies or is deemed inappropriate. Clients who repeatedly violate listing policies may have their service suspended or terminated.
TC7.6 — Clients remain solely responsible for the accuracy of their advertisements and for fulfilling their legal obligations to buyers.
TC8.1 — It is entirely the responsibility of the vendor to declare and pay for any taxes that arise from the sales of any product or service that you have ordered to be displayed on any web page produced by JWBIZ Ltd.
TC8.2 — JWBIZ Ltd will accept absolutely no responsibility for those who choose not to declare and pay any taxes due.
TC9.1 — The following material is not allowed on JWBIZ Ltd Web and Landing Pages: pornography, political views, gambling, and offensive/racist/defamatory comments; any type of weapon or anything that may be considered to be a weapon, whether real or fake; any type of ammunition, explosives, illegal drugs, perishable products, or any illegal products and/or services.
TC9.2 — JWBIZ Ltd Web and Landing Pages may not be used for advertising and/or organising illegal gatherings or any other type of illegal event.
TC9.3 — If you use JWBIZ Ltd Web and Landing Pages, you agree to keep the content up-to-date.
TC9.4 — You agree that out-of-date special offers or items that have been sold through advertisements must be removed or replaced.
TC9.5 — Any content that may mislead web and landing page visitors is strictly not allowed.
TC9.6 — Publishing any content that JWBIZ Ltd does not allow as described above in this section by using our CMS will result in web and landing pages being removed and accounts permanently closed with no refunds in arrears for services already provided.
TC10.1 — If you have purchased a package and wish to upgrade from a lower-cost category to a higher-cost category, we will calculate the difference in price depending upon the time left on the subscription and any extra work, if any, that may be required.
TC10.2 — Purchasing a lower-cost category and changing the content to a higher cost category using our CMS is not allowed.
TC11.1 — Renewals are charged annually and services will renew automatically unless you instruct us otherwise. If you would prefer to be notified before renewal so that you can decide whether to continue, please let us know and we will contact you by email or telephone prior to your renewal date.
TC13.1 — If you wish to cancel your services, please notify us at least 4 weeks prior to the expiry date by using the Quick Contact form.
TC13.2 — Please note that we do not give refunds in arrears for services already provided.
TC14.1 — This section applies to all clients after purchase of their initial product(s).
TC14.2 — All material for any edits or updates must be supplied in full by you prior to any work commencing. This is because we have to book work in. Failure to do this could result in a lengthy delay in completing work.
TC14.3 — Further charges will be applied if the material you supply for any edits or updates is changed after the work has been carried out.
TC14.4 — Any work carried out after your initial purchase is subject to a fixed hourly rate and is payable prior to work commencing.
TC15.1 — Pornographic, offensive, racist, defamatory, copyrighted material without written permission from the copyright holder to use it, or any illegal material, is not accepted.
TC15.2 — Images and videos whereby people may be clearly recognised in the foreground are not accepted without consent of the person(s) involved.
TC16.1 — Photos and videos will be the property of the Copyright Holder. That is usually the person that took the photographs and videos.
TC16.2 — The use of material whereby a copyright is in place is not accepted without a licence or written permission from the Copyright Holder. Proof may be required.
TC16.3 — For example: images from Google may not be downloaded or copied and used on your web and landing pages.
TC16.4 — Material licenced under the Creative Commons Licence is permitted on web pages produced by JWBIZ Ltd; however, attribution may be required.
TC17.1 — All web pages, websites, apps, and our landing pages need a Privacy Policy by law stating how you deal with visitor information they may send you, and that includes our landing pages. While our website has its own Privacy Policy it will not cover how you deal with visitor information on your landing pages.
TC17.2 — You agree that it is entirely your responsibility to provide a Privacy Policy for your web pages. The following options are available to you:
TC18.1 — This section applies where JWBIZ Ltd hosts software products or services on your behalf, including but not limited to booking systems, reservation platforms, and appointment systems, and where JWBIZ Ltd has built and deployed contact forms as part of your website. In these circumstances, JWBIZ Ltd acts as a Data Processor and you, the client, act as the Data Controller, as defined under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
TC18.2 — By agreeing to these Terms & Conditions, you acknowledge and agree to the following:
TC19.1 — JWBIZ Ltd reserves the right to alter prices on this website without notice.
TC20.1 — Should a server we manage require a rebuild due to being hacked, issues with upgrades, negligence, or work carried out by anyone other than JWBIZ Ltd personnel or any other reason that is not the responsibility of JWBIZ Ltd, all repair work will be chargeable in all circumstances.
TC21.1 — This is a help and advice service provided for those who may be hard of hearing, those who are in a noisy environment, and those who prefer not to use a telephone.
TC21.2 — It is also used for training purposes.
TC21.3 — Appointments for sessions can be made with times and dates by mutual consent.
TC21.4 — We have a zero tolerance policy against people using false identities, abuse, and foul language.
TC22.1 — As all work carried out by JWBIZ Ltd is bespoke and made to order, we do not offer refunds on completed work or services already provided. This does not affect your statutory rights.
TC22.2 — If you are not satisfied with any aspect of our work, please contact us and we will do our best to resolve the matter. Any concerns should be raised promptly so that we have the opportunity to address them.
TC22.3 — By placing an order or making a purchase with JWBIZ Ltd, you agree to these terms along with our Privacy Policy.
TC22.4 — Digital Content. Where you purchase digital content that is not supplied on a tangible medium (e.g. downloadable files, software, or other digital products), you expressly consent to immediate delivery or access to that digital content upon completion of your order.
TC22.5 — You acknowledge that, by giving this consent, you lose your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the equivalent EU Consumer Rights Directive once delivery or access to the digital content has begun.
TC22.6 — This consent and acknowledgement will be confirmed by you at the point of purchase (for example, via a checkbox at checkout) before your order is completed.
TC22.7 — Where digital content is faulty, not as described, or not fit for purpose, your statutory rights under the Consumer Rights Act 2015 are not affected.
TC23.1 — Any feedback, comments, ideas, improvements or suggestions (collectively, "Suggestions") provided by you to JWBIZ Ltd with respect to the website shall remain the sole and exclusive property of JWBIZ Ltd.
TC23.2 — JWBIZ Ltd shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.
TC24.1 — By using our website, registering an account, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our website or services.
TC25.1 — This Terms & Conditions applies only to the Services. The Services may contain links to other websites not operated or controlled by JWBIZ Ltd. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Please remember that when you use a link to go from the Services to another website, our Terms & Conditions are no longer in effect. Your browsing and interaction on any other website, including those that have a link on our platform, is subject to that website's own rules and policies. Such third parties may use their own cookies or other methods to collect information about you.
TC26.1 — All websites in the UK and the EU are required by law to have a Cookie Control System.
TC26.2 — All web pages made by JWBIZ Ltd will adhere to this law and have such a system.
TC26.3 — JWBIZ Ltd uses "Cookies" to identify the areas of our website that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our website but are non-essential to their use. However, without these cookies, certain functionality like videos may become unavailable or you would be required to enter your login details every time you visit the website as we would not be able to remember that you had logged in previously. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionality on our website correctly or at all. We never place Personally Identifiable Information in Cookies.
TC27.1 — You acknowledge and agree that JWBIZ Ltd may stop (permanently or temporarily) providing the Service (or any features within the Service) to you or to users generally at sole discretion, without prior notice to you. You may stop using the Service at any time. You do not need to specifically inform JWBIZ Ltd when you stop using the Service. You acknowledge and agree that if JWBIZ Ltd disables access to your account, you may be prevented from accessing the Service, your account details or any files or other materials which is contained in your account.
TC27.2 — If we decide to change our Terms & Conditions, we will post those changes on this page and update the revision date at the top of the page.
TC28.1 — JWBIZ Ltd reserves the right to modify, suspend or discontinue, temporarily or permanently, the website or any service to which it connects, with or without notice and without liability to you.
TC29.1 — JWBIZ Ltd may from time to time provide enhancements or improvements to the features/functionality of the website, which may include patches, bug fixes, updates, upgrades and other modifications ("Updates").
TC29.2 — Updates may modify or delete certain features and/or functionalities of the website. You agree that JWBIZ Ltd has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the website to you.
TC29.3 — You further agree that all Updates will be (i) deemed to constitute an integral part of the website, and (ii) subject to the terms and conditions of this Agreement.
TC30.1 — We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services ("Third-Party Services").
TC30.2 — You acknowledge and agree that JWBIZ Ltd shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. JWBIZ Ltd does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.
TC30.3 — Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.
TC31.1 — This Agreement shall remain in effect until terminated by you or JWBIZ Ltd.
TC31.2 — JWBIZ Ltd may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
TC31.3 — This Agreement will terminate immediately, without prior notice from JWBIZ Ltd, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the website and all copies thereof from your computer.
TC31.4 — Upon termination of this Agreement, you shall cease all use of the website and delete all copies of the website from your computer.
TC31.5 — Termination of this Agreement will not limit any of JWBIZ Ltd's rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.
TC32.1 — If you are a copyright owner or such owner's agent and believe any material on our website constitutes an infringement on your copyright, please contact us setting forth the following information: (a) a physical or electronic signature of the copyright owner or a person authorized to act on his behalf; (b) identification of the material that is claimed to be infringing; (c) your contact information, including your address, telephone number, and an email; (d) a statement by you that you have a good faith belief that use of the material is not authorized by the copyright owners; and (e) a statement that the information in the notification is accurate, and, under penalty of perjury you are authorized to act on behalf of the owner.
TC33.1 — You agree to indemnify and hold JWBIZ Ltd and its officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable legal costs, due to or arising out of your: (a) use of the website; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.
TC34.1 — The website is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, JWBIZ Ltd, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, JWBIZ Ltd provides no warranty or undertaking, and makes no representation of any kind that the website will meet your requirements, achieve any intended results, be compatible or work with any other software, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
TC34.2 — Without limiting the foregoing, neither JWBIZ Ltd nor any JWBIZ Ltd provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the website, or the information, content, and materials or products included thereon; (ii) that the website will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the website; or (iv) that the website, its servers, the content, or e-mails sent from or on behalf of JWBIZ Ltd are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
TC35.1 — Notwithstanding any damages that you might incur, the entire liability of JWBIZ Ltd and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the website.
TC35.2 — To the maximum extent permitted by applicable law, in no event shall JWBIZ Ltd or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the website, third-party software and/or third-party hardware used with the website, or otherwise in connection with any provision of this Agreement), even if JWBIZ Ltd or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
TC36.1 — If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
TC36.2 — This Agreement, together with the Privacy Policy and any other legal notices published by JWBIZ Ltd on the Services, shall constitute the entire agreement between you and JWBIZ Ltd concerning the Services. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and JWBIZ Ltd's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. You and JWBIZ Ltd agree that any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
TC37.1 — Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.
TC37.2 — No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.
TC38.1 — JWBIZ Ltd reserves the right, at its sole discretion, to modify or replace this Agreement at any time. Changes will be posted on this page with an updated revision date at the top of the page. It is your responsibility to check this page periodically for changes. Your continued use of our services after any changes are posted constitutes your acceptance of the revised Terms & Conditions.
TC39.1 — The Agreement constitutes the entire agreement between you and JWBIZ Ltd regarding your use of the website and supersedes all prior and contemporaneous written or oral agreements between you and JWBIZ Ltd.
TC39.2 — You may be subject to additional terms and conditions that apply when you use or purchase other JWBIZ Ltd services, which JWBIZ Ltd will provide to you at the time of such use or purchase.
TC40.1 — The website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by JWBIZ Ltd, its licensors or other providers of such material and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of JWBIZ Ltd, unless and except as is expressly provided in these Terms & Conditions. Any unauthorised use of the material is prohibited.
TC41.1 — This section applies to any dispute except it does not include a dispute relating to claims for injunctive or equitable relief regarding the enforcement or validity of your or JWBIZ Ltd's intellectual property rights. The term "dispute" means any dispute, action, or other controversy between you and JWBIZ Ltd concerning the Services or this agreement, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. "Dispute" will be given the broadest possible meaning allowable under law.
TC42.1 — In the event of a dispute, you or JWBIZ Ltd must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via the contact form on our website. JWBIZ Ltd will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and JWBIZ Ltd will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or JWBIZ Ltd may commence arbitration.
TC43.1 — If you and JWBIZ Ltd do not resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. The dispute shall be settled by binding arbitration in accordance with the arbitration rules of the Centre for Effective Dispute Resolution (CEDR) or such other arbitration body as JWBIZ Ltd may reasonably designate. Either party may seek any interim or preliminary injunctive relief from any court of competent jurisdiction, as necessary to protect the party's rights or property pending the completion of arbitration. Any and all legal, accounting, and other costs, fees, and expenses incurred by the prevailing party shall be borne by the non-prevailing party.
TC44.1 — In the event that you submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary and will become the sole property of JWBIZ Ltd without any compensation or credit to you whatsoever. JWBIZ Ltd shall have no obligations with respect to such submissions or posts and may use the ideas contained in such submissions or posts for any purposes in any medium in perpetuity, including, but not limited to, developing, manufacturing, and marketing products and services using such ideas.
TC45.1 — In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and payment made. If payment has already been received for such an order and the order is subsequently cancelled, we shall issue a refund in the amount of the charge.
TC46.1 — If for any reason a court of competent jurisdiction finds any provision or portion of these Terms & Conditions to be unenforceable, the remainder of these Terms & Conditions will continue in full force and effect. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by an authorised representative of JWBIZ Ltd. JWBIZ Ltd will be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. JWBIZ Ltd operates and controls the JWBIZ Ltd Service from its offices in Cardiff, United Kingdom. The Service is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, those persons who choose to access the JWBIZ Ltd Service from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. These Terms & Conditions (which include and incorporate the JWBIZ Ltd Privacy Policy) contains the entire understanding, and supersedes all prior understandings, between you and JWBIZ Ltd concerning its subject matter, and cannot be changed or modified by you. The section headings used in this Agreement are for convenience only and will not be given any legal import.
TC47.1 — JWBIZ Ltd is not responsible for any content, code or any other imprecision.
TC47.2 — JWBIZ Ltd does not provide warranties or guarantees.
